Question about the 10 Round limit on Firearms in CA?

I have a friend who said he would sale his 22lr to me its an older model marlin, the problem is it has the clip built on,(what ever you call that) and it holds 16 rounds could it be transfered to me legally with the 10 round limit or can he not sale it or what.
